Terms of Service

1. Purpose and acceptance

These Terms of Service (“the Terms”) govern access to and use of the GenBuild platform (“the Service”), available at gen-build.app, published by Nicolas Guigay, French micro-entrepreneur (SIRET 898 912 142 00020) trading as GenBuild (“GenBuild”).

Using the Service means you accept these Terms in full. If you do not accept them, you must not use the Service.

2. Description of the Service

GenBuild is a SaaS platform for generating no-code marketing websites with the help of artificial intelligence. It lets users create, customise and host professional websites in a few minutes.

The Service is offered under several pricing plans: Free, Solo, Agence. Which features you can access depends on the plan you subscribe to.

3. Sign-up and user account

To use the Service you must create an account with a valid email address and a password, or sign in with a Google account. You undertake to provide accurate information and to keep it up to date.

You are responsible for keeping your credentials confidential and for any activity carried out from your account. You must notify GenBuild immediately of any unauthorised use.

4. Ownership of content

You own 100% of the content you create through GenBuild: text, uploaded images, generated websites, exported HTML. GenBuild claims no ownership over your content.

GenBuild owns the platform, its algorithms, its library of reviewed sections and its user interface. These are protected by intellectual property law.

5. Export and data portability

HTML export of your website is guaranteed on every plan, Free included. You can download your website at any time from the dashboard or the editor.

In the event of cancellation, or if the Service is discontinued, GenBuild undertakes to keep the export feature available for at least 30 days after notice is given.

6. Subscriptions and payments

Paid plans are billed monthly or yearly. Payments are processed by Stripe. If a payment fails, the Service may be suspended after notice.

If you cancel a paid subscription:

• You keep paid access until the end of the period already paid for
• At that date, with no grace period: the account returns to the Free plan the same day. Websites published beyond the Free plan quota are taken offline; the one that stays online is no longer indexed by search engines and the GenBuild badge reappears on it
• The custom domain name is disconnected, unless it was bought through GenBuild: it stays attached to the website until the end of the one-year period already paid for
• No data is deleted — HTML export remains available

7. Discontinuing the Service

GenBuild undertakes to give users at least 60 days' notice before permanently discontinuing the Service. During that period, the export features remain available so that you can retrieve all of your content.

8. Acceptable use

You undertake not to use the Service to:

• Publish illegal, hateful, defamatory or pornographic content
• Carry out fraudulent or phishing activity
• Infringe third-party intellectual property rights
• Attempt to circumvent technical limits or quotas
• Deliberately overload the servers (DoS attacks)

Any breach may lead to immediate suspension or termination of the account.

9. Limitation of liability

GenBuild strives to keep the Service available (target 99.9%, on every plan) but cannot guarantee absolute availability. GenBuild cannot be held liable for indirect losses, loss of profit or service interruptions.

10. Changes to the Terms

GenBuild reserves the right to change these Terms. Significant changes will be notified by email with 30 days' notice. Continuing to use the Service after that period means you accept the new terms.

11. Governing law

These Terms are governed by French law. In the event of a dispute, the French courts have jurisdiction. Any disagreement will first be submitted to an attempt at amicable settlement.
